PSS Distributors - Sales and Advisory Terms and Conditions

These Terms govern the sale of goods and provision of advice by Legend Corporate Services Pty Ltd Trading as PSS Distributors, ABN 81-006-722-292 referred to as PSS Distributors. By placing an order or relying on our advice, you agree to these Terms.

Orders & Payment

We accept POs from approved account holders. Non-account customers must pay a non-refundable deposit or full payment before goods are built. No dispatch occurs until full payment is received. Payment methods: bank transfer and online card. Account terms are set upon approval; otherwise, payment is due Net 30/60 days. Prices are fixed for 28 days; after that, they may change. We reserve the right to charge interest or late fees on overdue payments.

Shipping & Delivery

Orders may qualify for Free Into Store (FIS) to your nominated store; damages must be reported in writing within 24 hours. Pickup and site delivery are available at an additional charge. Delivery and production times are estimates only; we are not liable for delays beyond our control.

Returns & Restocking Fees

Returns require authorization per our Returns & Warranties policy. Approved returns incur a restocking fee deducted from the refund/credit. Orders that are custom-built, made-to-order, or require manufacturing before dispatch may not be returnable at all or may be subject to a higher restocking fee due to the specialized nature of the build. Customers should confirm return eligibility before placing an order.

Warranty

Please refer our Returns & Warranties policy. Improper installation, use, neglect, or alterations void the warranty.

Retention of Title

Title remains with PSS Distributors until full payment is received. If unpaid, we may reclaim goods. Risk transfers to the buyer upon delivery.

PPSA Registration

We may register our interest in goods under the Personal Property Securities Act 2009 (Cth). The buyer agrees to assist with registration requirements.

Limitation of Liability & Indemnity

PSS Distributors provides industry-based advice but is not a licensed electrical contractor. The purchaser or recipient of advice must seek independent professional advice before relying on any recommendations.

The purchaser or recipient of advice is solely responsible for ensuring that:

• Site installation has been inspected, is safe, and complies with all relevant laws, regulations, and ordinances.
• Both the product and the site of installation are suitable for the intended use.
• The product is compatible with any other equipment being used in conjunction with it.

To the fullest extent permitted by law, PSS Distributors shall not be liable for any direct, indirect, incidental, consequential, or special damages, including but not limited to system failures, lost profits, business interruptions, injury, or death resulting from reliance on our advice or use of our products.

PSS Distributors' total liability, if any, shall not exceed the cost of the product supplied.

Intellectual Property & Confidentiality

All designs, drawings, and specifications remain our intellectual property. Confidential information must not be shared without written consent.

Dispute Resolution

Disputes must first be resolved via good faith negotiations. If unresolved, mediation applies before legal action. Legal disputes are governed by Western Australia.

Force Majeure

We are not liable for failure to perform due to events beyond our control (e.g., natural disasters, supply disruptions).

Export Control & Compliance

Buyers must ensure compliance with all applicable import/export regulations. PSS Distributors is not responsible for customs duties, tariffs, or legal restrictions.

Environmental & Disposal Responsibilities

Certain products contain lead-acid/lithium-ion batteries. The buyer is responsible for disposal per local environmental laws.

Amendments

These Terms may be updated periodically. The latest version is available on our website. Continuing to purchase from us or rely on our advice constitutes agreement to updates.
